Falls in Nursing Homes

Falls in nursing homes are often preventable. Residents may fall when they are not supervised, when call lights are not answered, when the environment is unsafe (e.g., wet floors, poor lighting), or when they are not given appropriate assistive devices. Many residents are at high risk for falls due to medication, mobility issues, or cognitive impairment. Facilities have a duty to assess risk and take reasonable steps to prevent falls. When they fail to do so, they may be liable for resulting injuries.

Fall injuries in nursing homes can include fractures, head trauma, and other serious harm. Recovery is often difficult for elderly residents. Proving that the facility was negligent requires review of care plans, staffing, and the circumstances of the fall. These cases can take time.

Pre-settlement funding helps families cover expenses while the case is pending. You repay only from your settlement or verdict. That way you can avoid settling for less than full value because of financial pressure.
